1. Seller and scope

These terms apply to DearTail Studio orders. The contracting seller is KD-BUYNOW TECHNOLOGY Kft., Kőrösi Csoma sétány 11., A. lház., 4. em., 18. ajtó, 1102 Budapest, Hungary, service@deartailstudio.com.

2. Formation of the contract

Product listings are invitations to place an order. You select a product and any offered variants such as colour, size or finish, add it to the cart and proceed through checkout. By selecting the final order button, you submit a binding offer. A contract is formed when we expressly accept the order or dispatch the goods.

You can identify and correct input errors before submitting the order. We retain contract and order information as required by law and send the essential order details by email.

3. Contract language

The contract language is German. This English version is provided for convenience. In the event of a conflict, the German version prevails to the extent permitted by law.

4. Products and product presentation

All products feature fixed artwork and are not customisable. You choose only the variants offered in the shop. Product images and colour previews aim to be accurate. Minor differences caused by screens, materials or normal production may occur; essential agreed characteristics remain unaffected.

5. Prices and payment

Displayed prices include applicable statutory VAT where charged. Shipping costs are shown separately before the order is placed. The payment methods offered at checkout apply, and payment is due according to the method selected.

6. Production, delivery and retention of title

Many items are produced with the fixed artwork by connected production partners after ordering. The delivery estimate shown before purchase applies. Partial deliveries are permitted where reasonable and without additional shipping costs. Goods remain our property until paid in full.

7. Right of withdrawal

Consumers generally have a statutory 14-day right of withdrawal for distance contracts. Our items are fixed, non-personalised products; production after ordering alone does not exclude that right. Details, return costs and the model form are in our withdrawal policy.

8. Statutory rights for defects

Statutory warranty rights apply. For damaged, faulty or incorrect goods, contact service@deartailstudio.com. Additional manufacturer warranties exist only where expressly stated for a product.

9. Liability

Liability is unlimited for intent, gross negligence and injury to life, body or health. For a slightly negligent breach of an essential contractual duty, liability is limited to foreseeable loss typical of the contract. Mandatory liability, including product liability, remains unaffected.

10. Intellectual property

Shop text, graphics, artwork, photos and other content are legally protected. They may not be reproduced, altered or commercially used beyond legally permitted use without prior consent.

11. Privacy

Our privacy policy explains how personal data is processed.

12. Applicable law and dispute resolution

Hungarian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. This choice does not deprive consumers of mandatory protection in their country of habitual residence.

We are neither obliged nor willing to participate in consumer arbitration unless mandatory law requires it.
